1. Brandwin.in will engage with the manufacturers and fulfil their demands and priorities regarding their products in accordance with our clients’ criteria.
2. As a consulting service, Brandwin.in does not charge its clients on a commission or margin basis.
3. When a packed product arrives from the manufacturer’s hub, a Brandwin.in representative will be there to conduct a quality check (QC) on the location or premises of the client. The client won’t receive the goods until the Quality Check Test is finished and they pass flawlessly. Products that are damaged or judged to be defective by the QC representative will be sent back to the manufacturer’s hub. The manufacturer will cover the shipping and return costs as it was his error to ship the defective goods to the customer and he will bear complete responsibility for them.
4. The buyer should be required to order the goods solely in accordance with the manufacturer’s Total Order Quantity (TOQ), and not less than the Minimum Order Quantity; otherwise, the order will be deemed invalid and won’t be taken into account by the company.
5. The Buyer is obligated to accept and agree that any bulk order placed in this manner won’t be fully met by the manufacturer until and otherwise it is confirmed and delivered within the allotted time. Until then, the condition isn’t met or achieved.
6. If any of the purchasers’ bulk orders are cancelled or suspended owing to an unforeseen Force Majeure incident, a significant network assault, or a system malfunction, they might no longer be available. In such a case, neither Brandwin.in nor any Manufacturer is responsible for any injuries or claims that result from it.
7. In the event of any dispute, the timing and legality of any transactions under this agreement shall be decided by Brandwin.in in its exclusive discretion based on its records. In the event of a dispute between a transaction held by a Buyer and one held by Brandwin.in, the decision made by Brandwin.in shall be final and binding.
8. Brandwin.in reserves the right to modify these Terms and Rules and/or terminate the transaction without providing previous notification to the buyer in the case that any disputes from the buyer arise at the time of making a Bulk order. Brandwin.in’s decision is final.
9. Brandwin.in is a service provider to the Manufacturers and Buyers; we reserve the right to disqualify, cancel, or revoke the rights of any Buyer who engages in any Malicious, Fraudulent, or Illegal Acts and Violates the Company’s Terms and Rules. Brandwin.in’s Legal Department also reserves the right to take any legal action it may deem appropriate.
10. The buyer may have to pay custom duties, taxes, and any other applicable costs or fees that may be imposed by law depending on the customs policies and local taxes of the destination country or state where the buyer is located. In the event of a conflict, either these Terms and Conditions or similar information provided elsewhere on the Brandwin.in online platform shall apply.
11. The Client must pay Brandwin.in any costs, expenses, fees, and taxes that may be incurred when making the payment to the manufacturer and/or in the process of refunding. If in case the Client pays any Advance amount to Brandwin.in company along with the Purchase Order (PO) and later cancels the order. This includes, but is not limited to, any payment transaction fee.

BRANDWIN.IN WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, LOSS OF DATA, LOSS OF BUSINESS ORLOSS OF PROFITS) ARISING OUT OF OR IN CONNECTION WITH THE BUYER’S AND SELLER FOR BULK PURCHASE, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT BRANDWIN.IN IS NOT RESPONSIBLE FOR ANY SUCH LOSS OR DAMAGE.
